Why Jury Trials Are Critical

Recently and increasingly, civil jury decisions have been overturned in Texas and across the country, and lawmakers have taken steps to restrict access to courts in civil matters.

One of the most critical components of our American society is the ability of a jury of our peers to decide disputes between parties. Men in women who are qualified to be jurors listen to the evidence and make informed decisions based on the law they are presented with and the facts they hear. In Texas, victims of serious accidents have found their way to the courthouse much more complex and expensive due to changes in the law, which make it much more difficult and more costly to bring actions against wrongdoers. Additionally, due to changes in our direction, inequities exist, such as giving a drunk driver the benefit of a victim paying for health insurance and reducing their lifetime caps without compensation for the same to the victim, and actions to shift responsibility to bankrupts and parties immune from lawsuits.

In the medical malpractice area, many victims of medical negligence cannot find a Texas lawyer to help them because of the excessive costs associated with the legal hurdles placed upon such a case in Texas. By capping human damages at $250,000, such as loss of a leg, a wrongful death, or having to sit in a wheelchair for life, the victims and sometimes the taxpayers end up holding the bag.

Further, changes in the law in Texas allow Korean, Chinese, and other foreign companies to escape responsibility for designing and manufacturing dangerous products sold in the United States. And at the end of the day, for those catastrophically injured by such hazardous products, the burden for their lifetime care can sometimes fall upon the taxpayers and not the foreign manufacturers who profit from Americans and sell the dangerous product.

One of the benefits of our jury system is that it has served as a force of good to ensure the protection of our citizens against those who negligently and irresponsibly violate rules in place Americans in jeopardy.

I say our jury system needs to be preserved and protected, and Texas consumers must come first.
